Ohio Supreme Court announces decision concerning release of state employee data, agrees with union

Sept. 8, 2005 - A decision was released yesterday by the Ohio Supreme Court: In Dispatch Printing Company, Inc. v. Johnson, Director of DAS, et al., the Supreme Court ruled in a 7-0 decision that the home addresses of state employees are not public records subject to disclosure under ORC 149.43, the Ohio Public Records Act. 

The Court held that:

"Home addresses are not records ... because they do not document the organization functions, policies, procedures operations, or other activities of the state and its agencies.  Consequently, state-employee home addresses are not subject to disclosure under the Public Records Act, and the Columbus Dispatch is not entitled to a writ of mandamus to compel disclosure of the addresses."
