Urge the Senate to vote no on Judge Samuel Alito's Nomination to U.S. Supreme Court
WHAT YOU CAN DO:

Urge your Senator to vote against Judge Samuel Alito’s nomination to the Supreme Court.

Tell them that Judge Alito is far too extreme to be on the Supreme Court and poses an enormous threat to the rights and freedoms of working men and women.

Jan. 12, 2006 - This week the Senate began hearings on the nomination of Judge Samuel Alito who President Bush has chosen to replace Justice Sandra Day O’Connor on the Supreme Court. AFSCME is strongly opposed to the Alito nomination. Judge Alito’s 15 year record on the bench clearly shows that he lacks respect for public workers and that he poses a threat to working men and women in this country.

Here is why we cannot support Judge Alito:

  • While serving on the third circuit, Judge Alito wrote an opinion in a Pennsylvania case that significantly limited the application of the Family and Medical Leave Act (FMLA) to state employees. Rightfully so, the Supreme Court ruled in disagreement with Alito, upholding the family care provision of the FMLA.
  • Judge Alito’s record shows a lack of respect for workers safety rules. In 1977 Judge Alito ruled against workers of a coal mine after the Mine Safety and Health Administration (MSHA) cited their employer for unsafe practices. Alito’s interpretation, had it prevailed would have deprived many workers of MSHA’s protections. In another case Judge Alito sided with a company that had been cited twice in just two years by the Occupational Safety and Health Administration (OSHA) for safety violations relating to the improper storage of dangerous chemicals.
  • Judge Alito has consistently voted to make it harder for working people to hold employers accountable for engaging in discrimination.
  • Samuel Alito supports limiting the power of the federal government to protect individuals who work for state and local governments.
